The President Mirziyoyev signed a decree introducing new mechanisms for protecting human rights through courts last Thursday.
One of the main novelties is the mandatory participation of government officials or their representatives in court hearings when considering complaints about their actions (omissions).
If an official or his/her representative fails to show in court and his/her absence is not due to some serious reasons, then he/she will be fined.
In addition, preliminary hearing procedure has been introduced in administrative proceedings. During the preliminary hearing, applicant's demands and defendant's objections shall be clarified, and measures shall be taken to eliminate the deficiencies outlined in the application.
The preliminary hearing shall be held no later than 20 days from the date of receipt of the application by court. This timeline shall not be added to the period established for the trial. Based on its findings, a decision shall be taken to return the application or appoint a trial on the case.
Administrative courts are now also entitled to consider cases of offenses related to disrespect for the court and failure to comply with its decisions.
Procedure for suspending operations on bank accounts of business entities recognized as tax debtors shall be introduced from May 1.
If business entity disagrees with the fact of a tax violation and the suspension of operations on his accounts, this issue shall be resolved by court on the basis of an application from the tax authority.
