On May 8, President Shavkat Mirziyoyev signed a Decree on priority measures to implement the new version of the Constitution. The Decree aims to "achieve a number goals of which cannot be postponed and to abolish conflicting provisions."

As we have already reported, from June 1, the procedure for issuance of e-invoices for p2p transfers, that is, the transfer of these data to tax authorities, shall be canceled, which contradicts the Article 41 of the Constitution on banking secrecy.

The Cabinet of Ministers was instructed to draft a bill to the Legislative Chamber within two months, which cancels the “On the list of categories of citizens of the Republic of Uzbekistan subject to registration at the place of permanent residence in the city of Tashkent and the Tashkent province Law, adopted in 2011. The document emphasized that this law restricts the rights of citizens to free movement around the country, as well as the choice of place of stay and residence, provided for in Article 32 of the Constitution.

The Ministry of Internal Affairs should develop a draft presidential decree within a month, which provides for a notification procedure for registering citizens at their place of residence.

In addition, (temporary) restrictions on the operation of any retail and service facilities will be lifted from June 1 “for the full implementation of the provisions related to the freedom of doing business (Articles 65-67 of the Constitution).

From January 1, 2024, in order to “fully ensure the constitutional rights of citizens to judicial protection”, a procedure shall be implemented according to which the state fee will be charged not from the applicant when applying to administrative courts, but from the guilty party based on the results of the case (Article 55 of the Constitution).

Within two months, the Decree instructed to abolish liability measures arising from contractual and other civil law relations (Article 21 of the Constitution).

In order to fully realize the constitutional rights of citizens to education, payments by taxpayers for the education of their child in educational institutions (preschool, school and higher), regardless of their age, are exempted from personal income tax (PIT) (Article 50 of the Constitution).

Within two months, the Decree instructed to develop a draft presidential decree providing for mechanisms for compensating victims of crimes (Article 29).

The Decree also instructed before August 1 to develop a procedure for introducing a mandatory medical examination before placing a person in an isolation cell when applying a measure of restraint in the form of detention - "in order to ensure constitutional rights to privacy" (Article 26).

In order to engage young professionals to attorney jobs, from September 1, 2023, the decree has allowed to allow graduate students of universities studying in the specialty "jurisprudence" to work as assistants to lawyers in law firms (Article 142).

From September 1, Uzbeks under the age of 18 will be able to visit cultural heritage sites for free, including exhibitions, historical monuments and shrines, as well as state museums.

The new version of the Constitution of Uzbekistan took effect on May 1. Within three months, a “program of measures to ensure the implementation of the socio-economic obligations of the state” enshrined in the Constitution must be approved.
