On September 13, President Shavkat Mirziyoyev signed a Resolution improving the procedure for coordinating inspection of businesses. The Resolution says that it was adopted as a result of an open dialogue between the head of state and business leaders on August 22.

The Resolution establishes that from November 1, the regulatory authorities are required to register all inspection of business entities in the information system "Unified State Control". Carrying out an inspection without registering in the system is deemed illegal.

The findings of inspections, as well as information on preventive measures, must be entered into the Unified State Control system within three days from the date of completion of an inspection or preventive measures.

The document introduces a procedure according to which regulatory authorities are obliged to notify a business entity of the start of inspections carried out on the basis of the “risk analysis” system no later than 10 working days in advance.

It is forbidden to re-inspect for the previously verified period of activity of a business entity and to demand the documents previously presented to them.

Supervisory authorities should carry out preventive measures for business entities on the basis of schedules agreed with the Business Ombudsman, in the form of seminars, public discussions, speeches in the media, as well as by providing handouts and manuals, sending recommendations and messages without interfering in the financial and economic activities of business entities.

Business entities have been granted the right not to allow officials of regulatory bodies to enter their territory to conduct an inspection, if the order to conduct an inspection is not issued in the prescribed manner, if the inspection is not agreed with the business ombudsman or he is not notified about it, if there is no special certificate giving the right for verification, as well as if authorized persons evade entering information into the book of registration of verifications.

From January 1, 2023, regulatory authorities are prohibited from conducting inspections of the activities of business entities for functions that are not included in the register of state regulatory functions in the Unified State Control information system.

The Resolution instructed the Ministry of Justice, together with the Business ombudsman, the Chamber of Commerce and Industry and regulatory authorities, to develop proposals by November 1 to reduce the government’s control functions and inspections.
