In Namangan, on September G. Dadabayeva, 35, poured gasoline and set herself on fire in response to her family being evicted from the house by officers of the Bureau of Compulsory Enforcement (BCE) under the General Prosecutor's Office and police.

The next day, she died from her burns in the Namangan branch of the Scientific Center for Emergency Medical Aid. The footage of the incident spread on social networks.

Her family living in a house in the Istikbol mahalla could allegedly become a victim of fraud. The mother of the deceased M. Dadabayeva bought the house two years ago for 13 thousand dollars from a woman who is currently serving a sentence of house arrest. The real owner of the property applied to court to return the house.

Background

The press service of the BCE reported that on October 8, 2019, the Namangan Interdistrict Civil Court decided the dispute in favor of the plaintiff A.D., and M. Dadabaeva and her family members were to be evicted by force.

The court decision was received for action by the Namangan city branch of the BCE on November 29, 2019, and on the same day a decision was made to initiate enforcement proceedings, copies of the decision were sent to the parties.

Later, on December 6, a warning letter was sent to M. Dadabayeva with an explanation of the need to leave the disputed house, as well as to bring to administrative liability and forced eviction in case of failure to comply with the requirement.

The family refused to vacate the house, and on December 12, a decision was made on forced eviction, about which M. Dadabayeva and the relevant departments were notified. However, in connection with the filing of a cassation appeal by M. Dadabayeva, which was later rejected, on the same day the enforcement actions were suspended.

On March 11 of this year, employees of BCE and other organizations, together with attesting witnesses, arrived at the house, but due to the absence of Dadabayeva, the enforcement actions were again postponed.

Due to the introduction of lockdown restrictions in Uzbekistan in mid-March, the execution of the decision was stopped until August 15.

Then, on September 17, the parties to the case were invited to the Namangan city department of the BCE, where they were re-explained the requirements of the enforcement proceedings, and the defendant was asked to voluntarily vacate the house.

M. Dadabaeva and her family did not voluntarily leave the house, and a forced eviction was scheduled for September 29, about which the defendant was notified, as well as the Namangan police Department, the city department of the Ministry of Emergency Situations, the ambulance service and the mahalla.

On the day of the execution of the decision, M. Dadabayeva and her daughter G. Dadabayeva allegedly resisted to the BCE officers, and G. Dadabaeva poured herself with gasoline and set herself on fire, the statement says.

On September 30, the woman died in the intensive care unit P. According to the press service of the Prosecutor General's Office, which refers to the conclusion of a preliminary forensic medical examination, G. Dadabayeva received burns of 90% of her body, of which 40% were deep burns, as well as a first-degree burn of the upper respiratory tract.

Criminal case

The Namangan prosecutor's office opened a criminal case under Incitement to suicide charge, medical, fire-technical and other examinations were assigned, the press service of the Prosecutor General's Office said.

In addition, an official check was appointed regarding the actions of the state executor of the Namangan city department of the BCE and the officers of the Namangan police department. The preliminary probe is ongoing.

The BCE press service noted that "appropriate measures will be taken against the guilty persons."

The Namangan city department of the BCE had an executive document in the process of collecting in favor of M. Dadabayeva from the debtor N.F. an amount equivalent to 13 thousand dollars (over 131.99 million soums), but the enforcement of the document did not take place.
