The MPs passed a bill mitigating penalties for certain traffic violations in the first reading Tuesday, introducing administrative warnings.
In particular, the bill has proposed to specify the list of violations in the Administrative Offences Code that can be recorded using photo and video recording cameras:
- Parts 1, 5 and 6 of Article 125 of the Administrative Offenses Code – failure to fasten seatbelt, driving a vehicle without license plate, driving a vehicle with a plate of another vehicle;
- Article 128 - driving vehicles on sidewalks, bicycle paths, green areas, breaching road signs;
- Article 128-1 - using a phone while driving;
- Article 128-3 - speeding;
- Article 128-4 — driving on red traffic light, crossing the stop line;
- Article 128-5 — obstructing the movement of special vehicles, causing an accident, driving into the oncoming traffic lane;
- Article 128-6 — violation of stopping and parking rules;
- Article 128-7 — driving on bus lane;
- Article 128-9 — violation of overtaking rules;
- Article 128-10 — road hooliganism;
- Article 129 — participation in a group movement that creates a threat;
- Article 130 — violation of the rules for crossing railway crossings;
- Part 2 of Article 135 — driving a vehicle by a person who does not have the right to drive a vehicle.
These violations can be recorded directly using photo and video cameras, as well as radars. As noted earlier, driving over road markings, except for the stop line, will not be recorded by cameras.
In addition, the timeline for issuing a ruling on a fine for an offense recorded by a road camera shall be reduced to one month (in case of appeal - no later than a year). The Chairman of the Committee for Combating Corruption and Judicial and Legal Issues Zhakhongir Shirinov said that in some cases, violation notices can be delayed for 7-8 months after the offense was committed. If the ruling is issued later than the specified period, the fine shall not apply.
The document has also proposed a new measure of influence - an administrative warning. A warning can be applied once a year to persons who have committed the following offenses for the first time:
- Article 125 - violation of the rules for driving vehicles, that is, driving without a seat belt, failure to pass technical inspection, failure to have a hammer for breaking glass, a fire extinguisher in vehicle;
- Article 128-1 — using a telephone while driving;
- Article 128-2 — using a monitor while driving;
- Article 128-6 — violation of stopping and parking rules;
- Article 135-1 — violation of compulsory insurance requirements;
- Article 138 — violation of traffic rules by pedestrians and other road users.
The MPs noted that the violations were selected based on statistics, as well as taking into account the absence of high public danger.
The bill has reportedly been developed on a directive of President Shavkat Mirziyoyev.
