President Shavkat Mirziyoyev signed a law introducing a system of penalty points for traffic violations Thursday, the Ministry of Justice said.
The Law has adopted liability through the application of administrative punishment for traffic violations for which penalty points are awarded.
According to the amendments, penalty points shall be awarded certain traffic violations, along with the main punishment. The maximum penalty points for one violation cannot exceed 2 points.
Penalty points shall be valid for one year from the date of the first violation. After a year, the collected points are automatically canceled.
If the quantity of penalty points exceeds 12 within a year, driver shall be deprived of the right to drive vehicles. The term of deprivation of rights cannot be less than 6 months. The maximum term of deprivation of a driver's license under the Administrative Liability Code is up to 3 years (Article 28), but it can be changed.
Penalty points for what traffic violations are?
According to the law (adopted by the Legislative Chamber), penalty points will be assigned under the new Article 34-1 of the Administrative Code for the following violations:
- Part 3 of Article 125 (driving vehicles with faulty braking systems, steering or coupling devices, or re-equipped without the appropriate permission);
- Part 5 of Article 125 (driving vehicles, the driving which is prohibited in accordance with the established procedure, as well as vehicles from which license plates have been arbitrarily removed);
- Article 126 (driving vehicles with mirrored and (or) tinted (darkened) windows, as well as with coatings that limit visibility);
- Part 1 of Article 127 (purposeless honking of a horn, installation of sound and light devices in vehicles not provided for by the manufacturer, as well as their re-equipment);
- Article 128 (driving on pedestrian paths, failure to comply with road signs and other traffic regulations);
- Article 128-3 (exceeding the established speed limit by vehicle drivers);
- Part 2 of Article 128-4 (driving through a red light or a prohibiting gesture of a traffic controller);
- Article 128-5 (creating an obstruction or emergency situation by vehicle drivers, driving onto the side of the road or a lane intended for oncoming traffic);
- Article 128-6 (violation of stopping or parking regulations);
- New Article 128-7 (violation of the procedure for transporting people in a vehicle);
- New Article 128-8 (violation of the procedure for overtaking vehicles);
- Article 129 (participation in group movement that creates a threat to road safety);
- Article 130 (traffic violations for driving through railroad crossing);
- Part 1 of Article 135 (driving vehicles without a driver's license, registration documents, an insurance policy, as well as without documents confirming the right of ownership, use or disposal of a vehicle in the absence of the owner, or without mandatory licenses, a waybill or a certificate of advanced training (in specified cases), as well as without registering powers of attorney, alienation and lease agreements);
- Part 1 of Article 137 (leaving the scene of a traffic accident in violation of established rules).
