On October 21, the President Mirziyoyev signed amendments to laws aimed at ensuring protection against family (domestic) violence. Children have been added to the circle of persons protected by articles on family (domestic) violence of the Code of Administrative Responsibility and the Criminal Code.
Thus, liability shall now be established for family violence against children. It should be noted that children have been added to the list of protected persons only in those provisions of these articles that imply physical violence.
While, amendments have been made to the Criminal Procedure Code, establishing that an application for reconciliation in cases related to domestic violence can only be filed at the trial stage.
Earlier, senators, approving the draft, explained that now reconciliation of the parties in cases of domestic violence would be impossible at the stage of inquiry and preliminary investigation.
“Why is this necessary? As a result of the couple's reconciliation before the trial, the accused party does not feel the inevitability of punishment and within a year commits violence again," Senator Malika Kadirkhanova said at the time.
The amendments are expected to improve the moral environment in families, prevent harassment and domestic violence against children, and improve the country's position in international indices related to ensuring children's rights.
