Director of an orphanage in one of the provinces of Uzbekistan allegedly forced three underage pupils to have sexual intercourse with the head of the provincial department of justice and the head of the district department for emergency situations for 10 months.

The court session, which considered the case against the director of the orphanage and the heads of two departments, took place in September 2022.

The Director of the orphanage took three girls in her care (Aziza, Rano and Dilya - names have been changed) and for 10 months (from May 2021 to February 2022) “used them for sexual intercourse with different men for financial reward ".

For example, in early May 2021, she chose Aziza, who at that time was not even 16 years old, and forced her to sleep with one of her acquaintances. The girl did not want to do this, she resisted, but then the manager forced her to bring a rolling pin from the kitchen and began to beat the girl's little brother in front of other children. Having broken the will of the girl, the manager later forced her to sleep with all the men with whom she ordered.

The head of the provincial department of justice allegedly promised to use his powers to solve the director’s problems, and in April 2021 he gave her a printer as a charity (it was on the balance sheet of the department of justice and was used in work, but later fell into disrepair).

A couple of weeks after such “charity”, the man demanded that the director of the orphanage provide him with a girl for sexual pleasures. Then she chose the 17-year-old orphan Rano and began to deprive her of food, isolated her from other children, forbade her to go out somewhere, and then said that she was obliged to sleep with the head of the provincial department of justice, because he bought the girl sports shoes for 250 thousand soums. As a result, the man slept with the girl, and to have sex with a minor he used an apartment that was allocated to the Department of Justice as a service house for employees.

A month later, in June 2021, the head of the provincial department of justice allegedly again “demanded the girl from the head and slept with 15-year-old Aziza in the same apartment, and later with 16-year-old pupil Dilya.”

History repeated itself over and over again… In fact, for 10 months, the service apartment of the provincial department of justice was used as a platform for sexual relations between the head of the provincial department of justice and underage girls.

The head of the department of emergency situations allegedly also promised the head of the orphanage to help solve her problems. In early May, he donated a children's sofa, a wardrobe, a kitchen table as a sponsorship and handed over various sweets to the children.

“In return, at the beginning of June 2021, he also demanded a girl for sex and slept with the aforementioned 17-year-old orphan Rano in the dormitory of the orphanage. At the end of June, he paid 200 thousand soums to the head of the orphanage and again slept with this girl. And then he brought food and drinks to the orphanage and, in return, forced 15-year-old Aziza to have sex. Girls were repeatedly forced to have sex with him, and meetings were held both in the orphanage itself and in other places, ”the project material says.

It is reported that at the trial, all the defendants stated that "the girls did it of their own free will and no one forced them."

In September, the court of first instance sentenced the head of the orphanage to 5 years and 6 months in prison under paragraph “a” of part 3 of Article 135 (trafficking in persons committed against a person who is known to be under 18 years of age), paragraph “d” of Part 2 article 167 (theft by appropriation or embezzlement by abuse of official position) and part 1 of article 209 (official forgery) of the Criminal Code of Uzbekistan.

The heads of the Department of Justice and the Department of Emergency Situations were found guilty of committing crimes under part 1 of Article 128 (sexual intercourse or satisfaction of a sexual need in an unnatural form with a person known to the perpetrator to be under 16 years of age) and the old version of Article 128-1 (introduction sexual intercourse with a person aged 16 to 18 by providing him with material values or property benefits) of the Criminal Code.

They received a punishment in the form of restriction of freedom for a period of 1 year and 6 months. They are prohibited from leaving their homes from 22:00 to 06:00, as well as changing their place of residence without the consent of the probation authorities and leaving their province of residence.

According to the website of the Supreme Court, the case under the relevant articles of the Criminal Code was considered by the judge of the Khiva District Court for Criminal Cases Dilmurod Atamuratov in early September 2022. The defendants in the case were the director of the orphanage, Yulduz Khudaibergenova, the former head of the Yangiaryk district emergency department, Anvar Kuryazov, and the former head of the Department of Justice, Aibek Masharipov.

It is worth noting that Aibek Masharipov was a member of the Khorezm Province Interdepartmental Commission on Combating Human Trafficking.
