Bill on approval of the Water Code aimed at regulating water-related relations was announced. The main proposed goals of the Code are:

  • sustainable supply of water to the public, economic sectors and ecological systems;
  • protection of water from pollution, contamination and depletion, prevention and elimination of harmful effects on water, improvement of the condition of water bodies, achieving an ecologically safe level of water use for the population and the environment, and maintaining it;
  • rational management, counting and use of water resources taking into account climate change;
  • facilitating the development of public-private partnership relations, provision of a part of water management facilities to water users and the private sector, development of other market mechanisms;
  • protection of the rights and legal interests of legal entities and individuals in the field of water relations;
  • development of interstate cooperation on water management issues.

Water facilities or their parts can be water use facilities and can be put to use based on the principles of public-private partnership in line with the procedure established by legislation, with the exception of reservoirs, flood reservoirs, as well as water management facilities with a high level of risk.

Water bodies can be used privately or be shared.

A water body that is given to legal entities or individuals for full or partial use in accordance with the procedure established by legislation is a water body for exclusive use.

A non-exclusive water body is a shared water body.

Water facilities are put to use in accordance with the procedure established by the legislation, in agreement with the bodies of water management, sanitary control, ecology and environmental protection, geology and mineral resources.

Water facilities are to be used by water users to meet the agricultural, drinking, medical and domestic needs of water consumers, resort, recreation and other needs of the population, industry, energy, transport, fisheries and other state or public needs in compliance with the requirements and conditions stipulated by the law. is given.

Depending on the conditions of provision of water facilities, water use is divided into general, special, separate and joint use.
