Performance of controlling bodies in Uzbekistan will no longer be evaluated by the number of detected offenses, enforcement measures or property seized from economic entities.

The draft amendments to the Law on state control over economic entities have been published for discussion on the Portal of online public services.

It is proposed to determine the performance effectiveness of controlling bodies on the following criteria:

  • raising of overall observance of laws and regulations by economic entities, prevention of systematic violations;
  • activities aimed at promoting the correction of faults committed by economic entities detected during inspection of activities;
  • preventing cases of company liquidation following audits.

The law is to be supplemented with a concept of "measures for prevention of offences by economic entities", which comprise a set of organizational and legal measures implemented by controlling bodies aimed at enforcing observance by economic entities of legislative acts and other normative documents, preventing and combating crimes, as well as the identification and elimination of causes and conditions.

In addition, based on the results of inspections it is suggested to hols post-inspection analysis aimed at identifying the systemic causes of unintentional violations of law by economic entities.

Amendments to this Law and to a number of other legislative acts have been developed pursuant to the Decree of Acting President "On additional measures to ensure the development of entrpreneurial activity, protection of private property and the qualitative improvement of business climate" dated October 5, 2016.
